According to Showalter (2017), the U.S. Healthcare System is the most regulated, this means that all members of the healthcare system should have knowledge of the laws and regulations in place. Some of the critical reasons include; compliance, liability, informed consent, ethics, and medical documentation. Compliance- healthcare members must adhere to and respect healthcare laws such as HIPAA to ensure complete patient privacy and protection (Schoppmann & Sanders, 2004). Liability- Having a strong understanding of health laws and regulations will allow physicians and other healthcare members to be able to defend themselves when faced with medical errors and allegations. This also helps with the mitigation of risks. Informed Consent- it is important for physicians to know all of the requirements for obtaining informed consent. Informed consent involves the patient having an understanding of the risks and benefits of a procedure or path of care before making a decision. The nursing home I work for is currently facing an informed consent issue where a Foley placement was made on a patient who was not alert and oriented. Ethics- The current ethical guidelines in place have served as a baseline for future decision-making (Ahronheim, 2009). It is important that physicians consider all ethical concepts such as autonomy, informed consent, negligence, beneficence, and justice in addition to keeping up with national cases. Medical Documentation- It is essential that all documentation is accurate and truthful as it can dictate the plan of care, overall health of the patients, and medical billing.
